Terms of Service

Throughout this document, "omegLOL," "we," "us," and "our" refer to Alexander Minch, the operator of the omegLOL service. "You" and "your" refer to the person accessing or using the service. "Service" means the omegLOL website, applications, and all related features.

By accessing or using the Service, you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service.

1. Eligibility and Age Requirement (18+)

1.1The Service is intended solely for adults. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to access or use the Service.

1.2By using the Service, you represent and warrant that you are at least 18 years of age, that you have the legal capacity to enter into these Terms, and that you are not barred from using the Service under any applicable law.

1.3The Service is not directed to anyone under 18. We do not knowingly permit minors to use the Service or knowingly collect information from them. If we learn that a user is under 18, we may suspend or terminate their access and delete associated information.

1.4Because the Service involves live video interaction with strangers, you acknowledge that age is a condition of access and that providing false age information is a material breach of these Terms.

2. The Service

2.1omegLOL is a competitive "try not to laugh" webcam game. Players are matched for short, live, one-on-one (1v1) or two-on-two (2v2) rounds in which one side performs and the other tries not to laugh, with an on-device camera signal used to keep score. The Service includes features such as ranked ratings, friends, lobbies, and leaderboards.

2.2Live video and audio between matched players are transmitted directly between participants (peer-to-peer). Laugh detection runs locally on your own device. See Section 8 (Privacy and Data) for what this means for your data.

2.3The Service is currently provided for desktop web browsers and requires a working camera and microphone. Availability, features, and system requirements may change (see Section 9).

3. Accounts and Guest Access

3.1You may use the Service as a guest or with a registered account.

3.2Guest access assigns your browser a randomly generated identifier stored locally on your device. Guest progress and identity are tied to that identifier and may be lost if you clear your browser storage.

3.3Registered accounts may be created with an email address and password or through a supported third-party sign-in (for example, Google). You are responsible for the accuracy of your registration information, for keeping your credentials confidential, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3.4You may not create or use an account or guest session to impersonate another person, to evade a suspension or ban, or in a manner that violates these Terms.

3.5You may hold only the accounts we permit and must not share, sell, or transfer your account or in-game identity.

4. Prohibited Conduct

You agree not to use the Service to engage in, facilitate, or promote any of the following. This list is illustrative, not exhaustive.

4.1Sexual and exploitative content

Explicit or sexual behavior of any kind is strictly banned and results in immediate termination of your access — including an instant ban and measures to block your device or network (IP address) from the Service — with no warning and no refund. Where minors are involved, related information is preserved and reported to NCMEC and law enforcement (Section 5.6).

You are solely responsible for your conduct and for anything you perform, say, transmit, or display while using the Service.

5. Reporting, Moderation, and Enforcement

5.1Right to enforce at our discretion. We may investigate suspected violations and may suspend, restrict, ban, or terminate any user's access to the Service AT OUR SOLE DISCRETION, with or without notice, and with or without cause, to the fullest extent permitted by law. We are not obligated to take, or to refrain from taking, any particular enforcement action.

5.2Reporting. The Service provides tools to report other players. When you submit a report, we may collect the report reason, any description you provide, the time, the players involved, and related context (see Section 8). Reports are reviewed through automated and/or manual processes.

5.3Automated moderation. YOU ACKNOWLEDGE AND AGREE THAT MODERATION AND ENFORCEMENT MAY BE PERFORMED IN WHOLE OR IN PART BY AUTOMATED SYSTEMS, WITHOUT HUMAN REVIEW. These systems may weigh factors such as the volume and pattern of reports against a user, the number of distinct reporters, the severity of the reported behavior, a reporter-reliability ("trust") score, and signals used to detect abuse or ban evasion. Automated systems may issue suspensions or bans automatically.

5.4No live pre-screening. Because live video and audio are transmitted peer-to-peer and are not received or stored by us (see Section 8), we do NOT and cannot review live streams in real time before you see them. Moderation is primarily reactive (for example, based on user reports and automated signals). You may encounter conduct or content that violates these Terms despite our efforts (see Section 6).

5.5Progressive and immediate enforcement. Enforcement may escalate with repeated or severe violations and may include temporary suspensions of increasing length or permanent bans. Serious violations may result in immediate permanent termination without prior warning. Different thresholds and durations may apply to guests and registered users.

5.6Zero tolerance for child sexual exploitation. Content that sexualizes or exploits minors is strictly prohibited. We may remove such content and accounts, preserve related information, and report to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement as required or permitted by law.

5.7No appeals at this time. Enforcement decisions are, at present, final and not subject to an appeals process. We may add or change review or appeals procedures at our discretion.

5.8Trust and reputation signals. The Service may maintain internal reliability or "trust" scores and similar signals to help distinguish good-faith reports and users from abuse. These signals are for operating and securing the Service and are not guarantees of any outcome.

6. Assumption of Risk; User Interactions

6.1The Service connects you with strangers over live, peer-to-peer video and audio. YOU USE THE SERVICE AT YOUR OWN RISK AND ASSUME ALL RISK ARISING FROM THESE DIRECT PEER-TO-PEER INTERACTIONS.

6.2We do not control, endorse, or assume responsibility for the conduct, content, or communications of other users. Despite our prohibited-conduct rules and moderation, you may be exposed to material or behavior that is offensive, indecent, inaccurate, or otherwise objectionable.

6.3You are responsible for what you choose to show, say, and share on camera. Do not display anything you would not want a stranger to see, capture, or share. Although recording others without consent is prohibited (Section 4.5), we cannot prevent a determined party from capturing or misusing a live stream through means outside our control, and you assume that risk.

6.4You are responsible for evaluating, and bear all risks associated with, any interaction with other users, including any decision to communicate or meet outside the Service.

7. Intellectual Property

7.1Our property. The Service, including the omegLOL name, logos, software, source code, game design and mechanics, ranking systems, user interface, graphics, and all related materials we create, is owned by us or our licensors and is protected by intellectual property and other laws. Except for the limited right to use the Service under these Terms, we grant you no rights in our property. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written permission.

7.2Your content. As between you and us, you retain all ownership rights in the content you create and transmit through the Service, including your live performance, image, voice, and likeness ("Your Content"). We do not claim ownership of Your Content.

7.3License you grant us. Solely to operate and provide the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to transmit, route, and display Your Content to the other participant(s) in your match, and to process signals generated on your device (such as reaction and scoring data) as necessary to run the game. Because we do not store your video or audio (Section 8), this license does not include a right for us to record, retain, or reproduce your live stream.

7.4Feedback. If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free right to use it without restriction or obligation to you.

7.5Trademarks. "omegLOL" and associated logos are our trademarks. You may not use them without our prior written consent.

8. Privacy and Data — What We Collect and Do Not Collect

This section summarizes our data practices for the Service. If we publish a separate Privacy Policy, that policy provides additional detail and governs in the event of a conflict.

8.3How we use data. We use collected data to operate, maintain, secure, and improve the Service; to run matchmaking, ratings, friends, and leaderboards; to enforce these Terms and our safety rules; and to comply with law.

8.4Sharing. We do not sell your personal information. We may share data with service providers who help us operate the Service, and as required by law, legal process, or to protect the rights, safety, and security of users, the public, or us.

8.5Third-party sign-in. If you use a third-party sign-in (such as Google), your use of that provider is governed by the provider's own terms and privacy policy. We are not responsible for third-party services.

9. Changes to the Service and to These Terms

9.1Changes to the Service. We may add, change, suspend, limit, or discontinue any part of the Service (including features, game modes, ratings, and availability) AT ANY TIME, with or without notice, and without liability to you.

9.2Changes to these Terms. We may modify these Terms at any time. When we do, we will update the "Last Updated" date and post the revised Terms. Changes are effective when posted unless we state otherwise. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.

10. Disclaimers

10.1THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

10.2WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT OR CONDUCT OF OTHER USERS WILL BE APPROPRIATE, LAWFUL, OR RELIABLE.

10.3SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Limitation of Liability

11.1TO THE FULLEST EXTENT PERMITTED BY LAW, WE (AND OUR OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING ANY CONDUCT OR CONTENT OF OTHER USERS.

11.2TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US, IF ANY, FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

11.3THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Alexander Minch, his employees, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) Your Content or your conduct while using the Service, (c) your violation of these Terms, or (d) your violation of any law or the rights of any third party.

13. Termination

13.1You may stop using the Service at any time. If you have a registered account, you may request its deletion by contacting us at "[email protected]".

13.2We may suspend or terminate your access at any time as described in Section 5. Upon termination, your right to use the Service ceases immediately.

13.3Provisions that by their nature should survive termination will survive, including Sections 4-8 and 10-15.

14. Governing Law and Dispute Resolution

14.1These Terms are governed by the laws of Indiana, without regard to conflict-of-laws principles.

14.2Except where prohibited, you and we agree that any dispute will be resolved in the courts located in Marion County, Indiana, and you consent to their jurisdiction and venue.

14.3Before filing any claim, you agree to first contact us at [email protected] and attempt in good faith to resolve the dispute informally.

15. General

15.1Entire agreement. These Terms (and any policies referenced here) are the entire agreement between you and us regarding the Service and supersede any prior agreements on that subject.

15.2Severability. If any provision is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

15.3No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

15.4Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets, or otherwise.

15.5No third-party beneficiaries. These Terms do not create any third-party beneficiary rights.

15.6Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
